These terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or formation, are governed by and construed in accordance with the laws of the Republic of South Africa.
9. Dispute resolution
We aim to resolve any complaint or concern you may have about the site informally first. Please contact us using the details in section 11 below. If a dispute cannot be resolved informally within thirty (30) days, the dispute will be referred to mediation administered by the Arbitration Foundation of Southern Africa (AFSA) in accordance with its then-current mediation rules, before any formal legal proceedings are commenced.
If mediation does not resolve the dispute, the parties consent to the jurisdiction of the Magistrates' Court for any district in Gauteng having jurisdiction under section 28 of the Magistrates' Courts Act, 1944, in respect of any legal proceedings arising from these terms, notwithstanding that the amount in issue may exceed that court's ordinary jurisdiction. We reserve the right, however, to institute legal proceedings in any competent court in respect of any breach of these terms.
10. Changes to these terms
We may revise these terms from time to time to reflect changes in the law, our site, or our business. The updated version will be posted on this page with a revised "Last updated" date. Material changes that affect your rights will, where reasonable, be highlighted on the site's home page for a reasonable period before they take effect.
